Statutory warranty:
- The retailer is liable for all material defects and legal defects that already existed at the time of sale
The statutory warranty period is 24 months, and a guarantee can never reduce or replace the statutory warranty. - During the first 12 months, it is legally presumed that the defect already existed at the time of sale. After the first 12 months and up to 2 years after delivery of the purchased item, the buyer must prove that the defect already existed at the time of sale.
Manufacturer’s guarantee:
- In addition to the statutory warranty obligation, a guarantee is a voluntary offer from the manufacturer and can be designed freely.
- As the functionality is guaranteed for a certain period, the guarantee applies regardless of the condition of the product.
- Statutory warranty claims are not replaced or reduced by guarantee claims
- Repairs for damage caused by the customer or damage occurring after the manufacturer’s guarantee has expired are subject to a charge under the manufacturer’s guarantee
